Comfort Membership Terms & Conditions
1. Parties and covered service. This agreement is between Cincy Climate Control (the "Company") and the member named in this enrollment (the "Member"). It covers only the service property and equipment listed here. The Member confirms they own the property or have authority to approve service and payment.
2. Membership year and visits. Every plan includes two seasonal maintenance visits per membership year: one spring air-conditioning visit and one fall furnace visit. Benefits apply only to listed equipment and only while the membership is active and current. An unused visit does not convert to cash or automatically carry forward.
3. Plan benefits.
Essential ($14.99/mo or $169/yr): two seasonal visits, spring AC maintenance with standard condenser-coil cleaning, fall furnace maintenance with one standard filter change, maintenance reminders, safety inspection, priority scheduling.
Preferred ($24.99/mo or $279/yr): everything in Essential, plus discounted diagnostic/service-call fees, 10% off eligible repairs, front-of-line priority scheduling, discounted indoor-air-quality products, efficiency reporting, outdoor-unit detailing.
Elite ($39.99/mo or $449/yr): everything in Preferred, plus 15% off eligible repairs (replaces the 10%), emergency priority scheduling, one waived diagnostic/service-call fee per year, after-hours/emergency service access (subject to availability; extra charges may apply), drain-line treatment when applicable, loyalty replacement credit, exclusive member promotions.
4. Visit scope. Spring visit: clean accessible outdoor condenser coil; inspect refrigerant conditions, electrical components, capacitor and contactors; flush accessible condensate drain; test thermostat; measure temperature split when possible. Fall visit: inspect burners and flame sensor; test safety controls; visually inspect accessible heat exchanger; check gas pressure and ignition; inspect electrical components; verify airflow and blower operation; test thermostat; replace one standard filter. A maintenance visit is not a guarantee equipment will not fail later. Repairs, parts, refrigerant, permits, and code upgrades are not included unless separately quoted and approved. No additional paid work is authorized by this agreement.
5. Recurring-payment authorization. By signing, the Member authorizes the Company and its payment processor (QuickBooks Payments) to charge the payment method on file for the recurring amount and frequency selected, beginning on the first charge date shown in the enrollment confirmation. Charges continue each annual term until cancelled. The Company does not retain full card details in this form.
6. Billing date. Membership charges are billed on January 1 of each year at the selected plan rate and billing frequency. For enrollments completed in 2026, the first membership charge occurs on January 1, 2027 — nothing is charged at enrollment. Stated membership benefits apply during the waiting period. Unless cancelled before that date, recurring charges begin January 1, 2027. The $29 tune-up is a separate service charge, not a membership payment, and is not one of the two included membership visits. The first included membership visit is spring 2027 AC maintenance.
7. Failed payments. If a payment fails, the Company may notify the Member and allow a reasonable opportunity to update the payment method, and may suspend benefits while an amount is past due.
8. Renewal and cancellation. The membership has an initial one-year term and renews for successive one-year terms unless cancelled. Monthly billing is a payment schedule for the annual term. The Member may cancel by phone (937-527-8558), email, or mail; cancellation is effective when received. Future recurring charges stop after cancellation. Amounts already paid are not refunded except as required by law. Annual prepayments are nonrefundable after an included visit is used.
9. Price or plan changes. Pricing or benefits may change only for a future renewal term and only after legally required advance notice.
10. Not insurance or a warranty. This is a preventive-maintenance and priority-service program, not an insurance policy, home warranty, or guarantee of uninterrupted operation.
11. Liability. Each party is responsible for loss caused by its own negligence or misconduct. To the fullest extent permitted by law, the Company is not liable for indirect, incidental, special, or consequential loss from delay, equipment failure, or unavailable parts.
12. Transfer. The membership applies to the listed property and equipment only and does not automatically transfer to a buyer, tenant, new address, or replacement system.
13. Notices. Routine notices, receipts, reminders, and cancellation confirmations may be sent to the email or mobile number provided. Marketing consent is separate and not required.
14. Governing law. The law of the state where the service property is located governs.
Working draft. Final benefit values (filter limit, diagnostic fee, IAQ discount, replacement credit) and company contact details will be completed before launch and confirmed with the member at enrollment.
